§ 1 Scope and Provider

These General Terms and Conditions (hereinafter "GTC") govern the sale of products by bthebusiness (hereinafter referred to as the Provider) to you, in their version valid at the time of your order.

Deviating GTCs of the customer are rejected.

Please read these terms carefully before placing an order with bthebusiness. By placing an order with bthebusiness, you agree to the application of these terms to your order.

bthebusiness offers the following products for sale: Clothing.
§ 2 Conclusion of the Contract

Contracts on this portal can only be concluded in English.

The offers are exclusively aimed at end customers with a billing and delivery address worldwide. For certain bulky items, the possible delivery addresses and the place of delivery may be restricted; the restriction is indicated in the respective list price.

The customer must be at least 18 years old.

The presentation of goods in the online shop does not constitute a legally binding offer. By presenting the goods, the customer is merely invited to make an offer.

Your order constitutes an offer to bthebusiness to conclude a purchase contract. The customer makes a binding offer by completing the online order process and clicking the "Order with Obligation to Pay" button in the last step of the order process.

The purchase contract between the Provider and the customer is concluded only through an explicit acceptance by the Provider. This occurs at the earlier of either the shipment of the goods or the sending of a shipping confirmation via email. Note that the confirmation of receipt of your order does not constitute acceptance in the aforementioned sense.

The validity of contracts for quantities exceeding household needs or the commercial resale of the purchased item requires explicit confirmation by the Provider. This applies both to the number of products ordered within an order and to placing multiple orders of the same product, where the individual orders comprise a household quantity.

Your orders are stored with us after the contract is concluded. If you lose your order documents, please contact us via email or phone. We will send you a copy of the order data.

You agree to receive invoices electronically. Electronic invoices will be made available to you via email or in your customer account on the website. We will inform you for each delivery in the shipping confirmation whether an electronic invoice is available.
§ 3 Prices and Shipping Costs

All prices are final prices and include the statutory value-added tax.

In addition to the stated prices, we charge shipping costs for delivery. These are clearly communicated to you on the shipping costs page and during the ordering process.
§ 4 Delivery

Unless otherwise agreed, delivery of the goods is made from our warehouse to the address provided by you.

On the website, you will find information about the availability of products sold by bthebusiness (e.g., on the respective product detail page). Please note that all information on availability, shipping, or delivery of a product is only approximate values and approximate guidelines. They do not represent binding or guaranteed shipping or delivery dates unless expressly designated as binding in the shipping options for the respective product.

If bthebusiness determines during the processing of your order that the products you ordered are not available, you will be informed separately via email. A contract for the unavailable goods does not come into effect.

If delivery to the customer is not possible because the delivered goods do not fit through the entrance door, front door, or stairway, or because the customer is not found at the address provided, even though the delivery time was announced with reasonable notice, the customer bears the costs for the failed delivery.
§ 5 Payment

Payment can be made via advance payment, transfer, credit card, or other payment methods.

The selection of available payment methods is at the discretion of bthebusiness. We reserve the right to offer you only certain payment methods for payment, for example, to hedge our credit risk, only advance payment.

For credit card payments, your credit card account will be charged upon completion of the order.

When paying by invoice, the invoice amount must be settled within 14 days.

You agree to receive invoices and credit notes exclusively in electronic form.
§ 6 Retention of Title

The goods remain the property of bthebusiness until full payment has been made.

Before the transfer of ownership, pledging, transfer by way of security, processing, or transformation without the express consent of bthebusiness is not permitted.
§ 7 Right of Withdrawal

Consumers have a fourteen-day right of withdrawal.

§ 8 Transport Damage

If goods are delivered with obvious transport damage, please report such defects to the carrier as soon as possible and contact us immediately.

Failure to make a complaint or contact us has no consequences for your statutory claims and their enforcement, particularly your warranty rights. However, you help us assert our claims against the carrier or transport insurance.
§ 9 Warranty

Unless expressly agreed otherwise, your warranty claims are based on the statutory provisions of sales law (§§ 433 ff. BGB).

If you are a consumer within the meaning of § 13 BGB, the limitation period for warranty claims for used goods – deviating from the statutory provisions – is one year. This limitation does not apply to claims arising from damage to life, body, or health or from the breach of a material contractual obligation, the fulfillment of which enables the proper execution of the contract in the first place and compliance with which the contractual partner may regularly rely on (cardinal obligation), as well as to claims based on other damage caused by an intentional or grossly negligent breach of duty by the user or its vicarious agents.

Otherwise, the statutory provisions apply.
§ 10 Liability

We exclude our liability for slightly negligent breaches of duty, provided these do not concern essential contractual obligations, damages resulting from injury to life, body, or health, or guarantees, or claims under the Product Liability Act.
